Terms.

The basis on which training and consultancy are provided.

Who you are contracting with

Michael Lynch Safeguarding, 14 Arconagh, Naas, Co. Kildare, Ireland.

How online training is supplied

Online training is charged per person. Access is for the named learner only and may not be shared. A certificate is issued to each learner who completes the course and the assessment, in the name of the purchasing organisation.

How consultancy engagements are agreed

Scope, deliverables and fees are agreed in writing before work begins. Where an independent review is undertaken, terms of reference are agreed in writing and the report is produced to those terms.

What your organisation owns afterwards

Documents produced for your organisation are yours, to hold, amend and rely on. Course material, the assessment and the platform remain the property of Michael Lynch Safeguarding.

What training and consultancy do not do

Training and consultancy support your organisation in meeting its obligations. They do not transfer those obligations. Responsibility for compliance with the Children First Act 2015, and for reporting, remains with your organisation and with its mandated persons.

Reporting obligations under the Children First Act 2015

Nothing agreed here limits any obligation to report a child protection concern to Tusla or to An Garda Síochána, and no confidentiality term will be read as doing so.

Cancelling a booking or an engagement

Consultancy engagements may be ended by either party in writing; work completed to that point is payable. Training purchases are refundable where the learner has not begun the course.

Governing law and jurisdiction

These terms are governed by the law of Ireland, and the courts of Ireland have exclusive jurisdiction.
